Summary:The present work seeks to present and problematize the idea of ​​resocialization and reintegration from a conceptual debate. For this, it goes through its presence, as a background, in the policies for the Brazilian prison system until its sociological problematization. It attests that while other countries point out a decline in the rehabilitative ideal, together with the exponential growth of the incarcerated population, in Brazil, despite its punitive character and high incarceration rates, this discourse is relatively new and ascending. The methodological course has a bibliographic review on the literature related to the topic and a review of legal regulations on official websites from a qualitative approach. With this, it questions the way in which the prison population is conceived, as well as the entry of certain rights and benefits in Brazilian prisons and the justifications for the existence and historical permanence of prisons that, albeit indirectly, contribute to the legitimacy of the institution itself.
