Summary:Introduction: Rapid digitization has impacts on everyday life, considerably impacting activities in all areas, especially those related to document management. Objective: To map and present the national scenario on legal issues involving digital preservation. Methodology: The study presents a qualitative approach, using documentary research, with a characteristic of bibliographic review. Results: Decree nº 10,278 of March 18, 2020, was a milestone, as it establishes legal grounds for digitized documents, including preservation, supporting actions aimed at digital documentary management.  Conclusion: the applicability of the recent regulations and their effects reflect on the importance of documents in relation to their validity for archives, with regard to their authenticity and reliability.
