The text's main argument is that the constitutional regulatory process produced an unprecedented political notion of "quilombo remnant communities" that impacted the proper lands they occupied. Based on the constitutional association between land and culture, the right to the land the "remnants" occupied was produced and legitimised through the unprecedented notion of " common usage land". Out of this combination, the legal apparatus of the Brazilian state forged the possibility of living on private land, but inalienable meant and intended for common use only.

Este artigo analisa o processo de regulamentação do artigo 68 do Ato das Disposições Constitucionais Transitórias de 1988 que trata das terras para comunidades remanescentes de quilombo. Para tal, examinamos os documentos como projetos de lei, minuta de decretos e decretos que visaram regulamentar ou regulamentaram o artigo. O argumento principal do texto é o de que o trâmite do processo de regulamentação produziu uma noção política e constitucional singular de remanescentes das comunidades dos quilombos e das áreas que ocupavam. A partir da associação constitucional entre terra e cultura, o direito à terra dos remanescentes foi produzido e legitimado pela noção também inédita de terra de uso comum. Dessa combinação, emergiu, no aparato jurídico do Estado brasileiro, a possibilidade racializada de vida em uma terra privada, porém inalienável e de uso comum. Universidade Estadual de Campinas.
