| Summary: | This article analyses the juridical category of “patrimony”, pointing out the unbreakable relation between the humanist ideology and the juridical form. In order to do that, it criticizes Hegel’s juridical philosophy in general and M. Hauriou’s juridical theory of patrimony in particular. The anthropological problematic is present in both theories where the subject’s essence appears to be the capacity ofwill, whose self-development through the practices of the natural or legal persons results materially in the patrimony. The patrimony, whatever its content may be, formalizes the practical of the human essence of the legal subjects and constitutes its goal, working as a condensation point of the juridical-anthropological speech. |
