Examino neste artigo a tese da natureza capitalista do direito, argumentando que, ao contrário de uma tese bastante defendida na literatura brasileira, a forma jurídica, assim como a forma-mercadoria e o capital, existem, de maneira contida, nos modos de produção pré-capitalistas. Isto ocorre em razão da ligação entre a forma jurídica e a forma-mercadoria, descoberta por Pachukanis. Esse direito pré-capitalista, conforme argumento, é e não é direito; é e não é a negação do privilégio.
